Privacy Policy Statement


On December 21, 2001, new legislative provisions came into force within Australia which govern the way organisations hold and handle personal information.

INTERCOMM NETWORKING respects your privacy and is committed to protecting your personal information. INTERCOMM NETWORKING has published this Privacy Policy Statement in order to demonstrate its firm commitment to privacy and to comply with the Privacy Act and the National Privacy Principles.

By submitting an online order form, or by using INTERCOMM NETWORKING's service, Customer hereby agrees to the following Privacy Policy. Customer agrees that it shall comply with and require its end users to comply with this Privacy Policy, INTERCOMM NETWORKING's Terms of Service (TOS), INTERCOMM NETWORKING's Acceptable Use Policy (AUP), and INTERCOMM NETWORKING's No-Spam Policy (NSP). 4. Non-Personally Identifiable (Generic) Information.
In general, INTERCOMM NETWORKING gathers some generic information automatically. Generic information does not reveal the identity of the visitor. FURTHERMORE, CUSTOMER ACKNOWLEDGES AND AGREES TO SUCH FLOWS OF HIS OR HER PERSONALLY IDENTIFIABLE INFORMATION ACROSS BORDERS FROM HIS OR HER COUNTRY TO AUSTRALIA OR THE UNITED STATES OF AMERICA.

INTERCOMM NETWORKING accepts credit card payments for services on this website. We utilise the PayPal credit card payment gateway to facilitate the accepting of your credit card charge authorisation online.

There is NO permanent storing of your credit card data or transaction history online with either PayPal or INTERCOMM NETWORKING.

Once INTERCOMM NETWORKING is in receipt of your credit card charge authorisation, as far as the internet is concerned it is as if the transaction never occurred. Nothing exists in any database on any web-server pertaining to your credit card numbers or details of your transaction. No names, no credit card numbers, no credit card expiry dates, no amounts, nothing is permanently stored online.

This is very different to almost every other web hosting company where details from your credit card transaction will be permanently stored on web servers on the internet, either by them themselves or by their "real time" payment gateway. Indeed, with most you can even "log in" to update your credit card numbers online - proof your credit card details are being permanently stored on a web server accessible on the internet.

It is a fact that no matter how good the security, when data is permanently stored on web servers and accessible online it can never be guaranteed 100% safe. In fact a large portion of credit card fraud in the world today can be directly attributed to the storing of credit card details within "secure" databases on web servers. The cost of credit card fraud runs into over $600 million USD per year and it is on the rise.

Subsequently, the Payment Card Industry Data Security Standards were developed by a consortium of credit card providers including Visa, Master Card and American Express, primarily to produce and enforce new tougher laws designed to reduce risks associated with online credit card transactions. The organisation is known as the Payment Card Industry Data Security Council.

Recent new rules as released by the Payment Card Industry Data Security Council, the standard known as the PCI DSS (Payment Card Industry Data Security Standard), state, amongst other things, that if credit card data is being captured and permanently stored in databases on web servers then PCI DSS certification is required. Without proper PCI DSS compliance credit cards can not be permanently stored on web servers. Any company or individual doing so now risks heavy fines and the suspension of their merchant account facility by their bank. Any merchant services department of any bank will confirm this as will Visa Asia Pacific, Master Card, American Express, etc..

There is no escaping the need to comply with these new requirements. Anyone who attempts to capture and store credit card details online may be liable under the new laws. For example, the small website owner who runs a basic shopping cart on a shared web server that captures and stores credit card details from their customers may now be genuinely taking an enormous risk as is anyone who asks their customers to send credit card details by normal email.

Web designers, webmaster, webhosts and anyone involved with creating, designing, producing or operating a website that captures and stores credit card data online without PCI DSS compliance may also be deemed responsible.

If you are currently accepting credit cards online by a method that you may suspect is not compliant to the new rules of the PCI DSS, we suggest you urgently make contact with you merchant account facility provider (your bank) to confirm things.

The PCI DSS is not a law; however, it is enforceable by the credit card companies through contractual penalties or sanctions. Implications of non-compliance can be severe. This new standard has teeth!!
